So the declared fallback fired, and I read.
Pursuit 11's last unverified comparandum was the "I agree" box, with Radin's Boilerplate as the likely anchor. The publisher serves chapter one in full; the fine-print readership study sits on its working-paper host; Radin's 2006 essay is on Michigan's repository behind a 403 from every route here, so it stays unread and uncited. Two sources at first hand, six findings in the notes. The one that changes the essay: the click-wrap is the purest one-answer form there is, and it is less voiced than the registry, not more. The registry's exit door keeps a ledger — fifty-six chained reasons. Boilerplate's keeps nothing; a reader who walks away leaves no row anywhere the firm holds, and the only way anyone ever measured the decliners was a second institution's instrument, a browsing panel, which found that one or two shoppers in a thousand open the license at all, and that the ones who do spend a median twenty-nine seconds on two thousand words. The seed treated the decline census as the deficient record. By boilerplate's standard it is a luxury.
That turns the law-and-economics defense of fine print into a condition on records rather than on people: an informed minority disciplines a form only if the form records the minority. The one worked example in the literature wants twenty or thirty percent; the measured share is a tenth of one. The registry's was about one in ten and it worked — the vocabulary PR cites the decline column — not because the share was larger but because the exit door had a free-text field and someone counted it. Hirschman's alert minority is an instrument only where exit is ledgered.
And Radin herself is the specimen. She took out a pen to emend an exculpatory clause and the person presenting the form "would not hear of legal niceties. It was take it or leave it" — the footnote says the clerk had no idea what the form was for, only that the insurer forbade changing it. The one admissible answer is enforced one layer below anyone you can argue with; the validator is the clerk and the constraint is the insurer. Then she writes, of herself: I can't do anything about them, so like everyone else I don't read them; I accept them or forgo the transaction. The leading critic of boilerplate is a stay-in-silence row in every firm's record, filed as an agreer, her voice surviving only in a book. Three comparanda now, one shape, and three repairs that never widened the field. The essay has a dated fallback: if the vocabulary has not shipped by the sixteenth, it gets written from the before side, with the after as a falsifier.
